Terms of Service

1. Acceptance of Terms

By accessing or using Notary Sites ("the Service"), operated by Solarsilk Interactive, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Notary Sites provides website design, hosting, and management tools for notary professionals on a monthly subscription basis. The Service includes access to a dashboard for editing your site content, a hosted public-facing website, and related features described on our pricing page.

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are 18 or older. We do not knowingly collect information from or provide the Service to anyone under 18.

4. Account Registration

To use the Service you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

5. Subscription and Billing

The Service is billed on a monthly basis. Your subscription begins after your free trial period and renews automatically each month until cancelled. Payments are processed by Stripe. You authorize us to charge your payment method on file for all fees due.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Free Trial

New accounts receive a free trial period after payment details are provided, as described on our pricing page. No charge is made until the trial ends. You may cancel at any time during the trial at no cost and you will not be charged.

7. Cancellation, Termination, and Refunds

You may cancel your subscription at any time through your account dashboard. When cancelling, you have two options:

• Cancel at period end - Your site remains live through the end of your current billing period. No refund is issued.
• Cancel immediately - Your site is taken offline within 24 hours and you automatically receive a prorated refund for the unused portion of your billing period.

After cancellation, your site and associated data are typically deleted within 60 days.

We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or any reason we deem necessary to protect the integrity of the Service. Refunds are not issued for terminations due to policy violations.

8. Your Content

You retain ownership of all content you upload or create through the Service (text, images, logos, etc.). By using the Service, you grant us a limited license to store, display, and serve that content solely for the purpose of operating your website.

You are solely responsible for ensuring your content does not infringe on any third-party rights and complies with applicable laws.

9. Acceptable Use

You agree not to use the Service to:

• Post or transmit unlawful, harmful, or fraudulent content
• Infringe the intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Violate any applicable local, state, national, or international law

10. Intellectual Property

The Notary Sites platform, templates, and all associated software are owned by Solarsilk Interactive, Inc. and protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute any part of the platform without our written permission.

11. Uptime and Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, unexpected outages, or events beyond our control may temporarily affect availability. We are not liable for any damages resulting from downtime.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Solarsilk Interactive, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Solarsilk Interactive, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

15. Dispute Resolution and Arbitration

Please read this section carefully - it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Westchester County, New York, or remotely if both parties agree.

You waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration. Each party must bring claims individually and not as a plaintiff or class member in any purported class or representative proceeding.

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Service after changes are posted constitutes acceptance.
